This homeowner is now responsible for thousands of dollars of the building and deck repairs including engineering drawings, city permits and contractor costs all because he failed to maintain his balcony deck. By not sealing his deck every few years he allowed moisture to penetrate the deck substructure causing structural damage to the building and his deck.
As stated in the CC&R and the Rules and Regulations, Homeowners are responsible for maintaining their decks and balconies as well as the railings around their decks and balconies. Any damage caused by their failure to maintain the decks, balconies and railings becomes their liability.
One indicator that a deck has lost its moisture barrier is that the stucco on the underside of the balcony will start to peel away. It is recommended that homeowners inspect their decks/ balconies and if they haven't been resealed within the last two or three years, action should take to do so before structural damage is incurred.
